Judicial Tribunal to review ban on Shabir Shah’s JKDFP

In a notification, the Ministry of Home Affairs(MHA) has set-up a tribunal headed by Justice Sachin Datta, Judge, High Court of Delhi, for the purpose of adjudicating whether or not there is sufficient cause for banning JKDFP headed by jailed Kashmiri separatist Shabir Shah.
The constitution of the tribunal is a legal requirement under the Unlawful Activities (Prevention) Act-1967.
The move comes 15 days after the MHA declared Shabir Shah's JKDFP as an unlawful association under the Unlawful Activities (Prevention) Act, 1967.
On October 5, the Government of India banned JKDFP for five years, citing “anti-India” and “pro-Pakistan” activities of the party.
The MHA said the members of the JKDFP have been at the forefront of secessionist activities in and and want to create a separate Islamic State. “The leader of members of the JKDFP have been involved in raising funds through various sources including Pakistan and its proxy organizations for perpetrating unlawful activities, including supporting terrorist activities, sustained stone-pelting on security forces in Jammu and Kashmir,” reads a notification issued by MHA on October 5, 2023.
