Court directs SSP to protect prime land of defunct Jammu Motors Corp from grabbers, trespassers
Jammu Tawi, May 11: A local district court passed an order directing the SSP Jammu for protecting and preserving a big chunk of attached land from the interference of Land Mafia. In an order passed by Ist Additional District Judge Mr. M A Chaudhary in a CMP no 103 of 2017 and CMP104 of 2017 titled Teerath Ram Amla & ors Vs Satish Kumar & Ors, the court directed the SSP Jammu to protect and preserve the prime property belonging to Jammu Kashmir Motor Corporation situated at Karan Nagar opposite to Jambu Lochan Banquet Hall from vandalizing and encroachment.
The counsel for applicant Tarun Sharma advocate moved an application for preservation of property stating the fact that once famous property of Jammu Motor Corporation now in shambles has been in the eyes of some influential people who with the help of henchmen of land mafia have been trying to vandalise the suit property which is custodia legis vide High Court order dated 4th Aug 1993. That irrespective of property being in custody of court since 1981 through appointed Receiver, some plaintiffs and defendants hand in gloves with land mafia dismantled the old structure of Jammu Motor Corporation and started digging new plinths to raise new structures. This incident by land mafia has challenged the authority of the court and in sheer violation of property being in custody of court started raising construction over the said suit property.
This act of the land grabbers clearly shows the involvement of influential people behind land mafia as the land is situated opposite to erstwhile Central Jail of Jammu and just few meters away from Police Station Pacca Danga. The land mafia has been hell-bent on land grabbing since the formation of new government and are posing a serious threat to law and order situation and violation of court orders.
The property situated at Karan Nagar which is in custody of the Court. The height of lawlessness is this that no one has been arrested till date and land grabbers are roaming free inspite of committing serious offences against the state and stakeholders.
Its high time that senior authorities should intervene and arrest the trespassers who unabatedly started raising construction in court property. Advocate Tarun Sharma vociferously pleaded before the court that suit property at Srinagar has already been alienated by some of the plaintiffs in spite of being it is custodia legis vide order dated 4th Aug 1993 passed by High Court in above mentioned suit which is still pending adjudication before the court of 1st Addl District Judge Jammu and brought the evidence before the court through pictures of vandalization going on spot. It was the timely intervention of the court vide order that suit property was preserved and high court order was implemented in letter and spirit otherwise land mafia would have alienated the suit property and would have run scot free.
