New Delhi, September 21: The Supreme Court on Wednesday was reluctant to advance the hearing on a PIL over the unrest in the Kashmir valley even as Panthers' Party chief Bhim Singh pleaded for taking up the issue soon, instead of November 18, the listed date.
“Jammu and Kashmir is on fire. The entire country is in danger,” Singh pleaded. But a Bench comprising Justices Anil R Dave and L Nageswara Rao said it would not be advisable to tamper with the date allotted by the computerised system.
As the senior advocate persisted with his plea for an early hearing, the Bench passed a one-line order stating that the “Registry may reconsider the date”.
In its PIL, the party had sought Governor's rule in the state but a Bench headed by Chief Justice TS Thakur rejected the plea. The Bench has, however, agreed to consider another prayer for ensuring availability of essential commodities such as food and medicine and services like education and health in order to protect people's fundamental right to life and dignity as guaranteed under the Constitution.
“Certain dimensions of the problem cannot be addressed by the court. You impress upon the government to accept your suggestions for improving the situation,” the Supreme Court had told Singh on August 22.
“The situation in the state keeps changing by the hour for which there is no judicial remedy,” the Bench had remarked then.
In the petition, the party said a “chaotic condition” prevailed in the state as the entire Valley was under siege, with no security to life and liberty and access to water, food and medicine.
