Jammu Tawi, Feb 11: District Magistrate Jammu, Dr. Rakesh Minhas, has issued a comprehensive order to regulate the functioning of spa and massage centres and prevent their alleged misuse for unlawful and immoral activities. The order has been promulgated under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
The action follows reports that some spa and massage centres operating in district Jammu were allegedly being used for immoral activities, prostitution and other unlawful acts, posing a threat to public order and safety.
The order defines a spa or massage centre as any premises, establishment, shop, clinic or commercial space — by whatever name called — offering massage, body therapy, spa therapy, wellness and relaxation services, ayurvedic therapy or physiotherapy (except those run by qualified registered medical practitioners), whether for consideration or otherwise. The directions apply to all such establishments within the territorial jurisdiction of district Jammu.
Under the order, any form of immoral activity within the premises is strictly prohibited. Cross-gender massage has been barred, with only male masseurs permitted for male clients and female masseurs for female clients. No internal locks, latches or bolts are allowed in treatment rooms, and services cannot be provided behind locked doors.
Installation of CCTV cameras at entry points, reception and common areas has been made mandatory, excluding private treatment rooms. Recordings must be preserved for at least 30 days.
The order stipulates that no spa or massage centre shall operate before 8:00 AM or after 9:00 PM. Night stay of any female employee on the premises is prohibited. Consumption or supply of alcohol and other intoxicants inside such establishments has also been banned.
Operators have been directed to ensure mandatory identity verification of customers and maintain a proper register with contact details. All employees must wear identity cards issued by the employer, and a staff register must be maintained. Engagement of persons below 18 years is prohibited. Police verification has been made compulsory for all owners, managers and employees, including therapists, receptionists and support staff.
Centres must display boards in English and Hindi at reception showing the site plan, category-wise number of beds for male and female sections, and employee details including designation and qualifications. Owners and managers are required to submit an affidavit to the nearest police station within 10 days, confirming compliance with all conditions.
Violation of the order will invite immediate closure and sealing of the premises, along with prosecution under relevant provisions of the Bharatiya Nyaya Sanhita and the Immoral Traffic (Prevention) Act.
The Senior Superintendent of Police, Jammu, has been tasked with enforcement, while SDMs and Tehsildars will conduct periodic inspections and submit compliance reports. The order takes immediate effect and will remain in force for eight weeks, unless modified or withdrawn earlier.
