    It is quite intriguing that the Jammu and Kashmir government has not learned the lessons from the previous mistakes as reports have confirmed that a blacklisted firm has been selected as the lowest bidder for hiring and installation of temporary toilets and bathing facility for Amarnath Yatra 2024.

    It is pertinent to mention that earlier also the government allegedly awarded a contract to tainted firm Aptech Limited, a Mumbai-based recruiting agency with a shadowy past across the country. The issue had been propped up in J&K at a time when Lieutenant Governor Manoj Sinha-led Union Territory (UT) administration was championing its ‘corruption free’ system post- August 5, 2019 when J&K’s special status was scrapped and the erstwhile state was downgraded to a UT.

    It is no secret that the recruitment process for many vacancies had gone haywire due to corruption charges, and investigation by the central agencies is still underway. After going through all this, it is really astonishing that the government in J&K is again accepting the challenge of giving work to a blacklisted firm raising many questions.

    All said and done, awarding tenders to tainted firms raises serious concerns about corruption and malfeasance within the government. This practice suggests a deliberate conspiracy between government officials and unscrupulous business entities, undermining public trust and compromising the integrity of the tendering process. When firms with a history of unethical practices are favoured, it not only jeopardizes the quality and reliability of public projects but also signals systemic issues within the governance framework.

    Addressing this issue requires stringent transparency measures, robust oversight mechanisms, and a commitment to holding all parties accountable to restore public confidence and ensure fair competition in government contracts.

    It is to be noted that M/s Bhutani International Pvt Ltd, which has been allegedly declared as the lowest bidder for the aforesaid allotment of work worth Rs 350 lakh, is currently blacklisted by a Government body in the State of Maharashtra.

    This work has been given in contravention of the eligibility criteria clearly mentioned in the tender document, according to which any bidder entity which has been barred by the Central Government, any State Government, a statutory client, or a public sector undertaking from participating in any project in last five years, would not be eligible to submit a proposal either by itself or through its associate thus raising number of questions about the tendering process accomplished in J&K.

    There is still a lot of time for the government to rectify things or else face saving would become difficult for those who have given nod to this wrongful act.
