The Special Judge (NDPS Cases), Jammu, denied bail to Garv Bhambri and Mamta Kansal, accused in a high-profile narcotics trafficking case (Crime No. 02/2024) involving commercial quantity of Codeine-based cough syrup (Corex) and other psychotropic substances.
Both individuals were alleged to be key figures in the operation of M/s N.K. Pharmaceuticals, a firm that was used, under the cover of a valid license and GST registration, for large-scale illegal drug supply. Bhambri was the licensee, while Kansal was GST handler and financier of the alleged racket.
The Narcotics Control Bureau (NCB), represented by Special Public Prosecutor Mr. Ajay Singh Manhas, presented case material, custodial statements, seizure reports, and extensive legal arguments demonstrating the gravity of the offence and the petitioners’ role in a wider drug syndicate. A total of over 300 bottles of CBCS, other controlled drugs, and ₹15.03 lakh in cash were recovered during investigations.
The Court, citing the rigour of Section 37 of the NDPS Act, multiple precedents from Supreme Court and High Courts, and ongoing investigation, found no reason to believe the accused were not guilty or unlikely to reoffend. It held the petitioners as probable kingpins behind the supply chain, operating through layers of shell firms and proxy fronts.
Judge Y.P. Sharma praised the thorough efforts and legal precision of Spl. PP Ajay Singh Manhas, who effectively anchored the prosecution’s objections with case law, government notifications banning Codeine Phosphate, and compelling forensic linkage.
Terming the case as one inflicting social harm and endangering the youth, the Court observed that drug traffickers inflict damage greater than a single act of violence. The bail applications were dismissed at the pre-charge stage, and matters were ordered to be tagged with the forthcoming charge-sheet.
