    SC Issues Pan-India Directions on Solid Waste Rules Compliance

    New Delhi, Feb 21: Flagging “uneven” compliance with Solid Waste Management (SWM) norms across the country, the Supreme Court of India has issued a series of pan-India directions to ensure effective enforcement of the SWM Rules, 2026, set to take effect from April 1, stressing that the right to a clean environment is inseparable from the right to life.

    A bench of Justices Pankaj Mithal and S V N Bhatti said the present generation cannot wait for further legislative refinement while implementation gaps persist, noting that source segregation of waste into wet, dry and hazardous streams remains incomplete in many urban and rural areas and large dumpsites continue in metros despite remediation efforts.

    Hearing appeals arising from National Green Tribunal orders on compliance by the Bhopal Municipal Corporation under the 2016 Rules, the court said municipal waste neglect harms public health and the economy and India must be fully compliant with the 2026 regime. It designated elected local representatives as lead facilitators for segregation awareness and directed district collectors to audit infrastructure, oversee waste management systems and report compliance gaps to chief secretaries in a time-bound manner.

    Local bodies were told to set deadlines for 100-per-cent compliance, submit photographic evidence of progress and ensure bulk waste generators meet statutory norms by March 31. Pollution control boards were asked to expedite segregation infrastructure, while the Environment Ministry was directed to integrate waste management into school curricula and translate citizen-focused rules into local languages.

    Non-compliance will attract fines, criminal prosecution and possible mobile courts for violations, the bench warned, mandating nationwide awareness campaigns to prepare for the April 1 rollout. (Agencies)
