    Jammu Tawi, December 20 (KIP):- Kashmiri separatists are in no mood to
    accept the supreme court's ruling that Jammu and Kashmir has no
    sovereign vistage and they cite the instance of Article 370 that gives
    special status to the state without realizing that if Jammu and
    Kashmir enjoys special status that is within Indian union.

    Hence, Supreme Court is right when it ruled that Jammu and
    Kashmir has no sovereign vistage without the constitution of .

    However, separatists say that Jammu and Kashmir was a sovereign
    entity before India could become a sovereign nation. The coalition
    Government is happy over the ruling of the Supreme Court saying that
    it has finally held the views of several political experts.

    Political experts argue that after Jammu and Kashmir acceded  to
    India and the way the instrument of Accession was signed by the last
    Maharaja of Kashmir and endorsed by the tallest political
    figure,SheikhAbdullah,there was no question for separatists to claim
    that the state had a sovereign entity.

    During the last 45  years scores of central laws are
    applicable in Jammu and Kashmir.Even the Election  Commission of India
    organizes the Assembly and the elections in Jammu and
    Kashmir.The state Assembly has approved the jurisdiction of the
    Supreme Court and Comptroller General of India in Jammu and Kashmir.
    How can then separatists claim that the state of Jammu and Kashmir has
    a sovereign entity.

    The only constitutional provision that separates Jammu and
    Kashmir from other states is Article 370 and the state subject
    law.Under Article 370 central laws passed by the parliament cannot be
    extended directly to  Jammu and Kashmir  without the concurrence and
    approval of the state legislature. And the state subject law no
    outsider can purchase land or any immovable property in Jammu and
    Kashmir. And no non-state subject is entitled to in the state
    Government nor seek admission in professional institutions. These
    facilities do not constitute sovereign entity. (KIP)
