SC Says Time Has Come for Uniform Civil Code, Urges Legislative Action

New Delhi, Mar 10: The Supreme Court has observed that the time has come for the implementation of a Uniform Civil Code (UCC) and said the matter should be addressed by the legislature.

A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and R Mahadevan made the observation while hearing a plea seeking to strike down provisions of the Shariat Act of 1937, alleging that they are discriminatory towards Muslim women.

The court described the petition as a “very good case” but said the issue is best examined by the legislature rather than the judiciary.

The bench also noted that striking down the Shariat inheritance law could create a legal vacuum, as there is currently no separate statutory framework governing Muslim inheritance if the existing provisions are set aside. (Agencies)
