Pawan accuses BJP of betrayal with Jammu 

Jammu Tawi, July 07: Lashing at local BJP Ministers and Legislators for their dimwit role supporting PDP's attempt to strengthen their separatists' agenda in Jammu , Pawan Gupta, MLA Udhampur said that the BJP leadership has fully exposed its caliber in understanding Jammu Kashmir and its politics.

He said it was he who first notices the hidden conspiracy of PDP and alerted the BJP MLAs individually who started asking questions to their senior leaders and a panic was created among them a day before the discussion on the said amendment of Transfer of Property Act aimed to clip the economic and progressive wings of Jammu.

Pawan told the Northlines that on his behest a floor strategy was arrived with BJP MLAs to scuttle the bill wherein BJP leaders asked him to take on the issue and oppose the bill as he being Independent MLA could do and by taking the benefit of pandemonium the bill be meet its fate of death.

He said, to his utter surprise, he was not given the time to express his point of view over the amendments rather two other BJP MLAs moved an amendment to refer the bill to select committee, being a part of afterthought strategy to highjack the issue for credit before public. He said in doing this they had done another blunder by keeping the Bill alive in select committee and the bill can resurface its ugly head as and when it suits the PDP.

On the last minute change in strategy the decision of the PDP-BJP Government to send the Transfer of Property Bill tabled in the State Legislative Assembly to Select Committee is just not enough. It has simply postponed the passing of a very regressive, backward looking and disruptive legislation only temporarily, The reference of the Bill to the Select Committee has ensured that a Damocles' sword continues to hang on the head of the nationalist constituencies in Jammu & Kashmir, as also on the free enterprise to promote trade and business of the people in the state.

The Bill practically bars the business and trade ventures of interested parties operating in rest of with the traders and business community of Jammu and Kashmir and rest of the country. This amendment bill with further nullify the J&K High Court and Supreme Court judgements that have safeguarded the inherited rights of property by the daughters of Jammu Kashmir who opt for marrying outside of state.

The separatist's insulation of the state from the Union of India gets further strengthened by this Bill and the separatist cause will only be furthered through the aegis of Legislative Assembly. It is intriguing the BJP chose to be a party in framing and approving of this bill on June 23, 2016, the day the nation was paying tributes to the martyrdom of Shyama Prasad Mukerjee. This vindicated those who have been warning since 2014 that the Union Government had planned a compromise on Jammu & Kashmir.

The Bill more precisely targets the business and trade interest of Jammu Province as this has been the main hub of industrial activity in the state because of a huge reserve of persons interested in free enterprise in the areas of trade and business. It should be known that whatever legitimate trade and industrial activity has survived in the state despite the crippling blows of terrorism and the pro-separatist Kashmiri leadership the private enterprise rooted in Jammu did not allow the of the state to die. The Bill will be a knocking blow to business and trade of Jammu.

It should also be noted that the Jammu which have been at the receiving end of employment activity will suffer further on the same account as the passing of the Bill will add immensely to the unemployment pool in Jammu Province. I also warn the nation that the passing of the Bill will make the availability of land and facilities for the security related purposes almost impossible and hence increase the degree of difficulty for the conduct of security related activities in the State. It will only aggravate the already deteriorating security situation in the state and cause great difficulty for Corporate Offices and Nationalized Banks which are operating in the state. If the Bill takes the shape of an Act, it will defeat the provisions of . 31 of the Indian Constitution. I fail to understand why the present dispensation took the decision for enactment of the controversial bill in haste despite the fact that no need was felt to bring such an enactment ever since the regime of Late Sheikh Mohd. Abdullah.

Last but not least, the Bill will boost the separatist cause in Jammu & Kashmir and ensure that separatism becomes the legitimate part of the legislative and administrative activity in the state. T

I urge all concerned in the Government in the state and New Delhi to realize the dangerous implications of this Bill and hence abandon it lock stock and barrel instead of incubating it in Select committee to be taken out of the closet at the whims and requirements of separatists in the State.
